ATTORNEY GENERAL’S OPINION ON SALE OF HEMP PRODUCTS

Live 5 News in Greenville, SC announced a recent crackdown by the State Law Enforcement Division (SLED) regarding smokable hemp and marijuana (See attached- Smokable hemp pulled from shelves across South Carolina – news article 07 23 19).

Recently, SLED obtained an Attorney General’s opinion on this issue. (See attached- Hemp – Attorney General’s Opinion – July 10 2019).  The office bases its interpretation off the Hemp Farming Act of 2019 that was signed into law by Gov. Henry Mcmaster in March.   The opinion, states “the statute makes it clear that the mere possession of raw unprocessed hemp or hemp not in a finished hemp product without a license is unlawful.”
